AI Photo Terms of Use

These Terms of Use (hereinafter referred to as the "Terms") govern your use of the AI Photo mobile application (hereinafter referred to as the "Application") provided by us.

By downloading or using the Application, you agree to be bound by these Terms. If you do not agree, please do not use the Application.

The name of this Application may vary in countries other than the United States and is subject to change at any time without notice.

1. Use of the Application

AI Photo is an iOS mobile application that provides features such as photo editing and AI imaging.

You may use the Application only for personal, non-commercial purposes, and you must comply with applicable laws, regulations, and these Terms.

2. User Eligibility

You must be at least 13 years of age (or the minimum age required by your jurisdiction) to use the Application.

This Application is not intended for children under the age of 13.

4. AI Processing and Cloud Services

Certain features within the Application rely on cloud-based AI image processing:

• Selected images may be temporarily uploaded to our servers to perform the processing
• Uploaded content is automatically deleted after processing is complete
• We do not store, share, or analyze your personal images beyond the scope necessary for the requested functionality

You retain ownership of all content you upload or process.

When using AI features, you grant us a limited, temporary license to perform the processing necessary to provide the Application's functionality.

5. Intellectual Property

All text, graphics, software, designs, trademarks, logos, and content within the Application, other than User-Generated Content, are owned by or licensed to XIN TU and are protected by intellectual property laws.

6. User Conduct

You must not use the Application for:

• Illegal, improper, defamatory, obscene, or intellectual property-infringing activities
• Providing the Application for use by third parties, renting, or selling the Application
• Malicious or disruptive operations

We reserve the right to pursue legal responsibility in accordance with the law.

7. Disclaimer

The Application is provided on an "as is" and "as available" basis without any express or implied warranties.

We do not warrant that the Application will operate uninterrupted, be error-free, or completely secure.

To the extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

In no event shall we be liable for:

• Indirect, incidental, punitive, or consequential damages

including but not limited to:

• Loss of profits, data loss, costs of legal proceedings, etc.

9. Termination

We have the right to suspend or terminate your access to the Application at any time, without prior notice, if you violate these Terms or for any other reason.

Upon termination, you must cease all use of the Application and delete any related installed files.

10. Updates and Modifications

We may update or modify these Terms at any time. Updates will take effect immediately upon posting within the Application or on our official website.

Continued use of the Application constitutes your acceptance of the latest Terms.

Additionally, the Application may be automatically updated through the App Store without notice.

11. Governing Law
